The duly noted® blog

Further to my posting on 10^th December about our discovery some of our web content was being used without clearance from us, I thought I’d post an update. 

abccopyright.com – the site we discovered using text from the homepage of our dulyregistered.co.uk site, we’d contacted and issued a Cease & Desist notice, giving them a deadline of close of business (GMT) yesterday (Thursday) 11^th December 2008 to remove the copied text. 

Well, after receiving no response from them (and the email we issued still failing to get through to them.  Good thing I had contacted them using their contact page), I monitored their site until the 6pm deadline, by which time… no action had occurred.  The site remained doggedly as-was. 

“Right then…” said I, and without further ado, I fired off a DMCA notice email to the Abuse Department of their service provider, Bluehost, informing them of the infringement.   

No action’s been taken as yet, but it’s been just twenty-four hours; it’d be unrealistic to expect such a fast turnaround.  But I’ll be conducting follow-up with them if I haven’t heard anything back from them by midweek next week. 

What puzzles us is abccopyright.com’s complete failure to respond.  Their contact email address not working was the first sign something might not be right with them.  Then the lack of even a delaying-tactic “We’ll get back to you ASAP” answer, when we sent via their contact page the original notice we’d emailed.  You’d think having something ominous like possible legal action hanging over your head like a sword of Damocles (now that’d be some judicial paper cut) would prompt some pretty swift response.  But no.  Zip.  Nada.  We’ve pondered the reasons why.  Perhaps they’re on holiday, or their mailbox is full.  Perhaps the business has folded even, and the site remains active… a ghost site – though that’s purely conjecture on our part. 

Anyways, their host has been notified of the infringement, and soon we’ll see what we shall see.
